Check out SFgate for this article regarding the Niner's move to Santa Clara, seems Assemblywoman Carole Migden is introducing legislation:

"But those goals -- and possibly the team's future in the Bay Area -- could be threatened, team officials hinted, if legislation introduced Thursday by state Sen. Carole Migden, D-San Francisco, passes. The bill, appropriately named SB49, would prevent governments from luring away sports teams from within a 100-mile radius."
